According to a copy of a signed resolution that was sent to us by Alex, one of our supporters, Perry County, Indiana has passed what it terms a “RESOLUTION IN SUPPORT OF AND DEFENSE OF THE SECOND AMENDMENT TO THE UNITED STATES CONSTITUTION AND ARTICLE 1, SECTION 32 OF THE INDIANA CONSTITUTION.”

It is worth noting that according to the signed resolution we received, the Perry County Board of Commissioners did include language about not adopting rules or ordinances that violate the Constitution, which is the type of language we do like to see in these resolutions.

RESOLUTION

RESOLUTION IN SUPPORT OF AND DEFENSE OF THE SECOND AMENDMENT TO THE UNITED STATES CONSTITUTION AND ARTICLE 1, SECTION 32 OF THE INDIANA CONSTITUTION

WHEREAS, the Second Amendment of the United States Constitution reads: “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed; and

WHEREAS, Article 1, Section 32 of the Indiana Constitution provides that: “The people shall have the right to bear arms, for the defense of themselves and the State”, and that “The military shall be kept in strict subordination to the civil power.”; and

WHEREAS, the Supreme Court of the United States of America in District of Columbia v. Heller, 554 U.S. 570 (2008) held that the Second Amendment protected an individual’s right to bear arms, and that said Amendment was not limited to the establishment and arming of a militia; and

WHEREAS, any unconstitutional attempts to infringe upon said rights are anathema to the establishment of our country as a constitutional republic and a government of laws rather than of men;

NOW, THEREFORE, the Board of Commissioners of Perry County, Indiana hereby resolve:

  1. That at no time shall it adopt any rule or ordinance regarding the right of its citizens to bear arms that violates the Constitutions of the United States and of the State of Indiana,
  2. That at all times it will defend the people’s right to bear arms as established by the United States Supreme Court. and that at all times it will adhere to the limitations of I.C. 35-47-11.1-2.
