On May 11, 2020, Noble County, Indiana Commissioners passed a resolution in support of the Second Amendment. The resolution passed unanimously with a vote of 3-0. However, the resolution was somewhat watered down due to concerns from the commissioners.

RESOLUTION IN SUPPORT OF THE SECOND AMENDMENT TO THE UNITED STATES CONSTITUTION AND ARTICLE 1, SECTION 32 OF THE INDIANA CONSTITUTION

WHEREAS, `the Second Amendment to the United States Constitution guarantees that the “right of the people to keep and bears Arms, shall not be infringed”;

WHEREAS, Article 1, Section 32 of the Indiana Constitution provides that “[t]he people shall have a right to bear arms, for the defense of themselves and the State”;

WHEREAS, the Supreme Court of the United States of America in District of Columbia v. Heller, 554 U.S. 570 (2008) held that the Second Amendment protected an individual’s right to bear arms, and that said Amendment was not limited to the establishing and arming of a militia; 

WHEREAS, the Supreme Court of the United States of America in Marbury v. Madison, 5 U.S. 137, (1803) held that “all those who have framed written constitutions contemplate them as fanning the paramount law of the nation, and consequently the theory of every such government must be, that an act of the legislature, repugnant to the Constitution, is void; and,

WHEREAS, the Board of Commissioners of Noble County, Indiana (“Commissioners”) have taken an oath to defend and uphold the Constitution of the United States and the Constitution of the State of Indiana, believe that the right of citizens to own, keep and bear arms is a fundamental right that should be protected to the greatest degree possible, and hereby express opposition to any law that would unconstitutionally restrict the rights of law-abiding citizens of Noble County to keep and bear arms.

NOW THEREFORE, the Board of Commissioners of Noble County, Indiana, hereby resolve that:

1. It hereby expresses its continued commitment to support all provisions of the Constitution of the United States and the Constitution of the State of Indiana, including the right of the people to keep and bear arms hereby express its strong support for the rights of law-abiding citizens of Noble County to keep and bear arms;

2. This Resolution shall be effective upon its approval.
