Piscataquis County Second Amendment Resolution (adopted June 15, 2021)

WHEREAS, the Board of County Commissioners of Piscataquis County deems it necessary and desirable to protect the rights of the citizens in Piscataquis County, Maine, concerning the rights of those citizens protected under the Second Amendment of the United States Constitution and under the Constitution of the State of Maine, Article I, Section 16;

WHEREAS, the Board of County Commissioners of Piscataquis County has reviewed the potential risk of the Federal Government enacting such laws, policies, statutes or standards that would potentially infringe on the rights of the citizens in Piscataquis County to possess firearms, ammunition, magazines or firearm accessories;

WHEREAS, the Board of County Commissioners of Piscataquis County finds that it is the Natural Born Right of the citizens of Piscataquis County to disallow the confiscation of firearms, ammunition, magazines or firearm accessories at the county level, except those actually used in the commission of a felony under the Maine law or those that are in the possession of a convicted felon as defined under Maine law, or those possessed in conflict with a valid court order issued pursuant to Maine law, or other lawfully restricted person under Title 15 §393;

WHEREAS, the Board of County Commissioners of Piscataquis County finds that it is the Natural Born Right of the citizens in Piscataquis County to disallow the confiscation of firearms during an emergency pursuant to Title 25 §2011;

WHEREAS, the Board of County Commissioners of Piscataquis County agrees with the finding of the Supreme Court of the United States that the right to bear arms is an individual right and to use arms in defense of hearth and home;

WHEREAS, the Board of County Commissioners of Piscataquis County derive their power from the State Legislature and the Legislature is bound by an oath to protect, honor, and abide by the State of Maine and United States Constitutions, as and so we must so honor our oath.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Piscataquis County that we oppose any enactment of Federal mandate, be it by way of statute, policy, laws, or standards, that will infringe on the right of the citizens in Piscataquis County protected under the Second Amendment of the United States Constitution and the Constitution of the State of Maine, Article I, Section 16, and in Maine law;

BE IT FURTHER RESOLVED that the Board of County Commissioners of Piscataquis County supports and recognizes the discretion of the Piscataquis County Sheriff’s Office to refuse to enforce any potential Federal mandate, be it by way of statute, policy, laws or standards that infringe on the right of Piscataquis County citizens protected by the Second Amendment to the United States Constitution and the Constitution of the State of Maine, Article I, Section 16 and in Maine law;

BE IT FURTHER RESOLVED that the Board of County Commissioners of Piscataquis County commits not to support, financially or otherwise, any enforcement of any new federal law, statute, policy or standard that will infringe upon the rights of the citizens in Piscataquis County which are protected through the Second Amendment of the Constitution of the United States and furthermore protected also by Article I, Section 16 of the Constitution of the State of Maine and in Maine law, additionally we fully support the enforcement of Title 15 §393 as written on this date.
