On April 5, 2021 Perkins County, Nebraska Commissioners passed a resolution in support of the Second Amendment. The Resolution passed unanimously.

PERKINS COUNTY, NEBRASKA RESOLUTION NO. 21-07

AFFIRMING THE RIGHT TO BEAR ARMS

WHEREAS, the Second Amendment to the United States Constitution states:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

WHEREAS, Section 1, of. The Constitution of the State of Nebraska states:

All persons are by nature free and independent, and have certain inherent and inalienable rights; among these are life, liberty, the pursuit of happiness, and the right to keep and bear arms for security or defense of self, family, home, and others, and for lawful common defense, hunting, recreational use, and all other lawful purposes, and such rights shall not be denied or infringed by the state or any subdivision there-of. To secure these rights, and the protection of property, governments are instituted among people, deriving their just powers from the consent of the governed.

WHEREAS, the Supreme Court of the United States has held that the Second Amendment to the United States Constitution guarantees an individual right to possess firearms independent of service in a state militia, Columbia v. Heller, 554 U. S. 570 (2008); and

WHEREAS, the Supreme Court of the United States has held that the Second Amendment to the United States Constitution applies to state and local governments as well as to the federal government, McDonald v. Chicago, 561 U. S. 742 (2010);

NOW, THEREFORE, BE IT RESOLVED that the Perkins County Board of Commissioners hereby declares that it supports the rights and liberties of all County citizens guaranteed by the Constitutions of the United States and the State of Nebraska;

BE IT FURTHER RESOLVED that the Perkins County Board of Commissioners hereby affirms that it supports the duly elected Sheriff of Perkins County, Nebraska, in the exercise of his sound discretion and affirms its resolve to support decisions by the Sheriff to defend the Constitutions of the United States and the State of Nebraska.
