On September 17, 2021, Niobrara County, Wyoming Commissioners passed a resolution opposing Federal Vaccine and Testing Mandates. The Resolution passed unanimously.

RESOLUTION 21-13

A RESOLUTION IN OPPOSITION TO COVID-19 VACCINE AND TESTING MANDATES

WHEREAS, President Biden has announced mandates requiring COVID-19 vaccinations for all Federal Employees and Contractors; and, 

WHEREAS, President Biden has announced mandates requiring all employers with 100+ employees to ensure their workers are COVID-19 vaccinated or tested weekly; and, 

WHEREAS, President Biden has announced mandates requiring COVID-19 vaccination for health care workers at Medicare and Medicaid participating hospitals and other health care settings; and, 

WHEREAS, President Biden has announced mandates requiring entertainment venues like sports arenas, large concert halls, and other venues where large groups of people gather to require that their patrons be COVID-19 vaccinated or show a negative test for entry; and, 

WHEREAS, Wyoming County Commissioners are sworn to support, obey and defend the Constitution of the United States and the Constitution of the State of Wyoming; and, 

WHEREAS, Amendment X of the Constitution of the United States, also known as one of the Bill of Rights, states: “The Powers not delegated to the United States by the Constitution, nor prohibited by the States, are reserved to the States respectively, or to the people.”; and, 

WHEREAS, Article I, Section 7 of the Wyoming Constitution states: “Sec. 7. No absolute, arbitrary power. Absolute, arbitrary power over the lives, liberty and property of freemen exists nowhere in a republic, not even in the largest majority.”; and, 

WHEREAS, Article I, Section 38 of the Wyoming Constitution states: “Sec. 38. Right of health care access. (a) Each competent adult shall have the right to make his or her own health care decisions. The parent, guardian, or legal representative of any other natural person shall have the right to make health care decisions for that person. (b) Any person may pay, and a health care provider may accept, direct payment for health care without imposition of penalties or fines for doing so. (c) The legislature may determine reasonable and necessary restrictions on the rights granted under this section to protect the health and general welfare of the people or to accomplish the other purposes set forth in the Wyoming Constitution. (d) The state of Wyoming shall act to preserve these rights from undue governmental infringement.”; and, 

WHEREAS, Article I Sec. 4. of the Wyoming Constitution states: “Security against search and seizure. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures shall not be violated, and no warrant shall issue but upon probable cause, supported by affidavit, particularly describing the place to be searched or the person or thing to be seized.”

NOW, THEREFORE, BE IT RESOLVED THAT:

1. The Niobrara County Commissioners believe Presidents Biden’s mandates are unconstitutional. 

2. The Niobrara County Commissioners oppose the implementation of any and all COVED-19 vaccination requirements or mandatory COVID-19 testing for any citizen of the United States, regardless of their employment. 

3. The Niobrara County Commissioners believe that the taking of a vaccine is a personal choice, and the right of refusal, as well as the right to accept a vaccination, should be fiercely protected.

4. The Niobrara County Commissioners encourage Governor Mark Gordon, Wyoming Attorney General Bridget Hill, and the Wyoming Legislature to prevent these mandates from being implemented or enforced in the great State of Wyoming.
