RESOLUTION NO: 655 “Second Amendment Preservation County” WHEREAS, the Constitution of the United States of America is the supreme law of our nation; and
WHEREAS, the Second Amendment to the Constitution states, “A well regulated militia being necessary to the security of a free State, the right of the people to keep and bear arms shall not be infringed”; and
WHEREAS, The Johnson County Board of Commissioners and the Johnson County Sheriff recognize that the Constitution of the United States was formed to serve the people of the United States of America and as such the people of Johnson County. The Johnson County Board of Commissioners and the Johnson County Sheriff support the purpose in forming the Constitution of the United States which provides “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution of the United States of America;” and
WHEREAS, The Johnson County Board of Commissioners and the Johnson County Sheriff harken hack to and recognize the words set forth in the Declaration of Independence as it provides wise guidance in the implementation of governance in Johnson County. We adhere to and support that “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the pursuit of Happiness;” and
WHEREAS, the Constitution of the State of Wyoming in Article 1, Section 24 states, “The right of citizens to bear arms in the defense of themselves and the state shall not be denied;” and
WHEREAS, the right of the citizens to keep and bear arms is guaranteed as an individual right under the Second Amendment to the Constitution of the United States of American and under the Constitution of the State of Wyoming; and
WHEREAS, the right of the citizens to keep and bear arms for the defense of Life, Liberty and Property is regarded as an inalienable right by the citizens of Johnson County, Wyoming; and
WHEREAS, in 1892 the right to bear arms by the citizenry of Johnson County repelled an invasion of our lands that resulted in the peaceful culmination of the Johnson County War; and
WHEREAS, the citizens of Johnson County, Wyoming, have a historical and cultural relationship with firearms for economic, recreational, hunting and shooting purposes conducted within Johnson County as allowed under the United States and Wyoming Constitutions; and
WHEREAS, it is the desire of the Johnson County Board of Commissioners and the Johnson County Sheriff to declare their support for the Second Amendment to the Constitution of the United States of America and Article 1, Section 24 of the Constitution of Wyoming protecting citizens’ inalienable and individual right to keep and bear arms; and
WHEREAS, the members of the Johnson County Board of Commissioners and the Johnson County Sheriff took an oath to support and defend the Constitutions of the United States and the State of Wyoming; and
NOW, THEREFORE, BE IT RESOLVED no funds from the treasury for Johnson County, Wyoming, resources or personnel may be used in a manner to abridge the rights of law abiding citizens to keep and bear arms as an individual right under the Second Amendment to the United States Constitution and under the Constitution of the State of Wyoming.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Johnson County Board of Commissioners and the Johnson County Sheriff strongly support the Second Amendment of the Constitution of the United States of America and Article 1, Section 24 of the Constitution of the State of Wyoming and that the Board of Commissioners and Sheriff strongly believe that it is an inalienable right of the citizens of Johnson County to keep and bear arms for the defense of life, liberty and property; and
NOW, FURTHER, BE IT FURTHER RESOLVED, to defend the rights and liberties of the citizens of Johnson County, the Johnson County Board of County Commissioners hereby declares Johnson County, Wyoming a
“Second Amendment Preservation County.”
RESOLVED this the Sixth Day of April 2021, in Buffalo, the county seat of Johnson County, Wyoming.
