BOARD OF COUNTY COMMISSIONERS OF GRANT COUNTY KANSAS Resolution No. 13-02.

A JOINT RESOLUTION OF THE CITY OF ULYSSES AND GRANT COUNTY KANSAS TO PRESERVE AND DEFEND THE SECOND AMENDMENT OF TFIE UNTIED STATES CONSTITUTION

WHEREAS, the Second Amendment of the Constitution of the United. States of America states that “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed,” and

WHEREAS, the Supreme Court of the United States of America, in two recent cases, District of Columbia v Heller and McDonald v Chicago, has held that the right to keep and. bear arms is an individual right, and

WHEREAS, the City Council. and the Mayor of the City of Ulysses, and the Board of County Commissioners of Grant County, Kansas desire to adopt a lbnnal Resolution to Preserve and Defend the Second Arnenclinent of the United States Constitution.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Ulysses, and the Board of County Commissioners of Grant County, Kansas, each sitting in a duly called. session as dated below, that: The City of Ulysses, Kansas and Grant County, Kansas will not enforce any unlawful and unconstitutional statutes, executive orders, or other regulations and proclamations which conflict with, and are expressly preempted by, the United States Supreme Court’s rulings on the right of an individual to keep and bear arms; and

BE IT FURTHER RESOLVED, that the City Council of the City of Ulysses, and the Board of County Commissioners of Grant County, Kansas call upon the United States Congress. the Governor of the State of Kansas and all elected officials of the State of Kansas to preserve and defend the 2nd Amendment of the Constitution of the United States as an individual, unalienable right of the citizens of the State of Kansas and to nullify any statutes, executive orders or other regulations and proclamations that infringe upon the right of an individual to keep and bear arms. 

This resolution was approved and adopted this 10th day of April, 2013.
