RESOLUTION NO. 2021-03 (Duly Adopt. January 5, 2021)
A RESOLUTION OF THE BOWMANSTOWN BOROUGH COUNCIL AND THE MAYOR OF BOWMANSTOWN, DECLARING BOWMANSTOWN AS A SECOND AMENDMENT SANCTUARY IN ACCORDANCE WITH THE SECOND AMENDMENT TO THE CONSTITUTION OF THE UNITED STATES OF AMERICA AND ARTICLE I, SECTION 21, OF THE CONSTITUTION OF THE COMMONWEALTH OF PENNSYLVANIA
WHEREAS, the Constitution of the United States is the Supreme Law of our nation; and
WHEREAS, the Second Amendment to the Constitution of the United States of America states: “A well-regulated Militia being necessary to the security of a frcc State. the right of the people to keep and bear arms shall not be infringed”, and
WHEREAS, the Pennsylvania Constitution, Article Section 21 states “The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.” and
WHEREAS, the Bowmanstown Borough Council and the Mayor of Bowmanstown are concerned about the passage, and enforcement. of any bill or legislation which could be interpreted as infringing the rights of the citizens of Bowmanstown to keep and bear arms or which may unduly restrict their right to thc same; and
WHEREAS, the criminal misuse of firearms is not a reason to infringe the rights of law abiding citizens of Bowmanstosrn, and
WHEREAS, the Bowmanstown Borough Council and the Mayor of Bowmanstown skish to express opposition to any law that would unconstitutionally restrict the rights under the Second Amendment of the U.S. Constitution and under the Pennsylvania Constitution of the citizens of Bowmanstown to keep arid bear arms; and
WHEREAS, the Bowmanstown Borough Council and the Mayor of Bowmanstown wish to express their intent to stand as a Sanctuary Borough for Second Amendment rights and to oppose, within the limits of the Constitutions of the Unit. States and the Commonwealth of Pennsylvania, any efforts to unconstitutionally restrict such rights, and to use such legal means at its disposal to protect the rights of citizens to keep and bear arms.
NOW, THEREFORE, be it resolved by the Bowmanstown Borough Council and the Mayor of Bowmanstown:
That the Bowmanstown Borough Council and the Mayor of Bowmanstown hereby express their intent to uphold the Second Amendment rights of the citizens of Bowmanstown and that public funds, resources, employees, buildings or offices not be used to restrict Second Amendment rights or to aid or assist in the enforcement of the unnecessary and unconstitutional restriction of the rights under the Second Amendment of the citizens of Bowmanstown to keep and bear arms; and
That the Bowmanstown Borough Council and the Mayor of Bowmanstown hereby declare Bowmanstown, Pennsylvania, as a “Second Amendment Sanctuary.”
This Resolution shall supersede or repeal all resolutions and parts thereof inconsistent or conflicting herewith.
Resolution shall become effective upon adoption
DULY RESOLVED, this 5th day of January 2021, by the Bowmanstown Borough Council and the Mayor of Bowmanstown, in lawful session duly assembled.
