RESOLUTION BY THE STEWART COUNTY, TENNESSEE COMMISSION DECLARING UNWAVERING SUPPORT FOR THE SECOND AMENDMENT OF THE CONSTITUTION OF THE UNITED STATES OF AMERICA

WHEREAS, the Second Amendment to the United States Constitution, adopted in 1791 as part of the Bill of Rights, protects the inalienable and individual right of the people to keep and bear arms; and

WHEREAS, it is the desire of the Stewart County, Tennessee Commission to declare its support of the Second Amendment to the United States Constitution and to protect the inalienable and individual right to keep and bear arms; and

WHEREAS, each member of the Stewart County, Tennessee Commission took an oath to support and defend the Constitution of the United States and hold inviolate the inalienable and individual rights of the citizens granted under the Constitution of the United States; and

WHEREAS, the United States Supreme Court in District of Columbia v. Heller, 554 U.S. 570 (2008), affirmed an individual’s right to possess firearms, unconnected with service in a militia, for traditionally lawful purposes, such as self-defense within the home; and

WHEREAS, the United States Supreme Court in McDonald v, Chicago, 561 U.S. 742 (2010), affirmed that the right of an individual to “keep and bear arms”, as protected under the Second Amendment, is incorporated by the Due Process Clause of the Fourteenth Amendment against the states; and

WHEREAS, the United States Supreme Court in United States v. Miller, 307 U.S. 174 (1939) opined that firearms that are part of ordinary military equipment, or with use that could contribute to the common defense are protected by the Second Amendment; and

WHEREAS, the Fourteenth Amendment to the Constitution of the United States, Section 1 states: “no state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor deny to any person within its jurisdiction the equal protection of the laws”; and

WHEREAS, the 111th General Assembly of the State of Tennessee has a bill, SB 0943, that authorizes the issuance of extreme risk protection order, “also known as a Red Flag Law”, that a law enforcement officer may seek to prevent a restrained person from being able to lawfully possess a firearm when the officer believes that the person is a danger to the person or another; and

WHEREAS, the Stewart County, Tennessee Commission declares its support of the Second Amendment of the United States Constitution and to protect the inalienable and individual rights to keep and bear arms and to hold those rights inviolate against all challenges.

NOW, THEREFORE BE IT RESOLVED that the Stewart County, Tennessee Commission hereby declares, Stewart County to be a “Second Amendment Sanctuary County”.

BE IT FURTHER RESOLVED that this resolution take effect from and after passage, the public welfare requiring it.
