On March 4, 2021, Echols County, Georgia Commissioners passed a resolution declaring the county a Second Amendment Sanctuary. The resolution passed unanimously.

ECHOLS CO RESOLUTION 2021 – 001: A RESOLUTION DECLARING ECHOLS COUNTY TO BE A SECOND AMENDMENT SANCTUARY COUNTY; EXPRESSING SUPPORT FOR THE SECOND AMENDMENT TO THE UNITED STATES CONSTITUTION; PROHIBITING SUPPORT OR FUNDING FOR PROVISIONS FOUND TO VIOLATE THE SECOND AMENDMENT; AND FOR RELATED MATTERS

WHEREAS, the members of the Board of Commissioners of Echols County, Georgia have been elected to represent the People of Echols County, Georgia and have been duly sworn by oath to uphold the United States Constitution and the Constitution of the State of Georgia; 

WHEREAS, the Second Amendment to the Constitution of the United States provides that: “A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed;” 

WHEREAS, the United States Supreme Court has affirmed an Individual’s right to possess firearms, unconnected with service in the militia, for traditionally lawful purposes, such as self-defense within the home, subject to certain lawful limitations. See District of Columbia v. Heller 554 U.S. 570 (2008); 

WHEREAS, the United States Supreme Court has affirmed that the right of an individual to “keep and bear arms,” is protected under the Second Amendment and is incorporated by the Due Process Clause of the Fourteenth Amendment to be applicable as against the states. See McDonald v. Chicago 561 U.S. 742 (2010); 

WHEREAS, the United States Supreme Court has affirmed that the federal government of the United States cannot compel state law enforcement officers to enforce federal laws. See, Printz v. United States, 521 U.S. 898 (1997); 

WHEREAS, Article I, Section I, Paragraph VIII of the Constitution of the State of Georgia, titled “Arms, right to keep and bear,” provides that, “(title right of the people to keep and bear arms shall not be infringed, but the General Assembly shall have power to prescribe the manner in which arms may be borne;’ 

WHEREAS, 0.C.G.A. § 1-2-6(a)(9) lists “[t]he right to keep and bear arms” among the rights of citizens;

WHEREAS, the citizens of Echols County, Georgia regard the right of people to keep and bear arms for the defense of life, liberty, and property as an inalienable right of the people;

WHEREAS, the citizens of Echols County, Georgia derive economic and social benefits from all safe forms of firearms recreation, hunting, and shooting conducted within Echols County; and

WHEREAS, it is the desire of the Echols County Board of Commissioners to declare its support for the Second Amendment to the United States Constitution and the provisions of the Constitution of the State of Georgia that protect Echols County Citizens’ individual, inalienable rights to keep and bear arms.

NOW, THEREFORE, BE IT RESOLVED by the Echols County Board of Commissioners that Echols County be, and hereby is, declared to be a “Second Amendment Sanctuary County.”

BE IT FURTHER RESOLVED that the Echols County Board of Commissioners affirms its support for the Second Amendment and for the Echols County Sheriff to the extent that he exercises his sound discretion to not enforce against any citizen an unconstitutional firearms law.

BE IT FURTHER RESOLVED that no agent, employee or official of Echols County, or any corporation providing services to Echols County, shall provide material support or participate in any way with the implementation of federal acts, orders, rules, laws or regulations which have been found to violate the Second Amendment to the United States Constitution.

BE IT FURTHER RESOLVED that the Echols County Board of Commissioners will not authorize or appropriate funds, resources, employees, agencies, contractors, buildings, detention centers or offices for the purpose of enforcing or assisting in the enforcement of any acts, laws, orders, mandates, rules or regulations that have been found to unconstitutionally infringe on the right of the people to keep and bear arms, and;

BE IT FURTHER RESOLVED, that all federal acts, laws, orders, rules, and regulations that have been found to violate the Second Amendment to the Constitution of the United States, and all state statutes, orders, rules, and regulations that have been found to violate Article I, Section I, Paragraph VIII of the Constitution of the State of Georgia or the Second Amendment to the Constitution of the United States, Shall be considered null and void and of no legal effect in Echols County, Georgia.

SO RESOLVED AND ADOPTED this 4th day of March 2021.
