CUSTER COUNTY, COLORADO RESOLUTION NO. 21-17

A RESOLUTION OF CUSTER COUNTY COLORADO, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO, DECLARING THAT PRESIDENT JOSEPH R. BIDEN BE HELD ACCOUNTABLE TO THE CITIZENS OF THE UNITED STATES FOR TREASONOUS ACTS HE HAS COMMITTED WHILE IN OFFICE

WE THE PEOPLE of Custer County, Colorado, compelled by the Love of Country and our Constitution, depend on our service members to volunteer to sacrifice everything, to include their lives, in service of the American people and the freedoms we enjoy. We believe that the actions and conduct of President Joseph R. Biden are inconsistent with his oath of office and his actions have irreparably damaged our defense capabilities and have adversely and significantly endangered the security, economic wellbeing and health of the United States and Custer County Colorado.

WHEREAS, the Board of County Commissioners for Custer County Colorado (Board), having taken an oath of office wherein they swore allegiance to support and defend the Constitution of the United States and the Constitution of the State of Colorado, declares that President Joseph R. Biden has demonstrated ineptness in strategic decision making and provided sophisticated weapons to a terrorist group and caused a lack of confidence from allied countries thereby placing American and Allied lives in peril which will directly impact the security of the United States and Custer County. The President failed to act in accordance with his sworn constitutional obligations and should therefore be held accountable as set forth more fully herein; and

WHEREAS, §1 of Article II of the Constitution of the United States establishes the Presidential “Oath of Office” and on January 20, 2021, President Joseph R. Biden swore to that oath of office pledging that he would, to the best of his ability, preserve, protect, and defend the Constitution of the United States; and

WHEREAS, §3 of Article III of the Constitution and of the United States and §18 U.S. Code 2381 established that “Treason against the United States, shall consist only in levying war against them, or in adhering to their Enemies, giving them aid and comfort… “; and defines the act of treason in part as “Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere is guilty of treason… “; and

WHEREAS, an exposed phone call between President Biden and the President of Afghanistan revealed there was no doubt a Taliban takeover was imminent, President Biden addressed the American people denying that threat; and

WHEREAS, when our fallen Marine, Navy and Army personnel were needlessly sacrificed, upon his orders, during the poorly executed plan to evacuate Afghanistan to the Dover military base, President Biden displayed indifference, disrespect and utter disregard for the lives sacrificed during a solemn, dignified return of those American heroes. President Biden has breached the responsibility bestowed upon him by the American people as Commander in Chief; and

WHEREAS, it is the opinion of this Board that President Joseph R. Biden gave aid and comfort to the Taliban, a known terrorist group that has regularly carried out deadly suicide bombings, tortured and killed civilians with impunity, and otherwise engaged in flagrant and brutish conduct with total disregard for basic human rights; and

WHEREAS, the complete and abject surrender of Bagram Air Base in Afghanistan to the Taliban was treasonous to the United States, and the billions of dollars of taxpayer funded weapons and military equipment freely and willingly turned over to the Taliban has compromised not only U.S. national security but has also compromised our allies and has degraded the safety of our global community; and

WHEREAS, the Board believes that the act of supplying to the Taliban a list of Americans and its allies still in Afghanistan on its merits alone constitutes an additional instance of treason toward the United States; and

WHEREAS, 8 U.S. Code §1324 establishes the several instances that “Bringing in and harboring certain aliens” is a crime under current U.S. law; and

WHEREAS, President Joseph R. Biden has, by means of unlawful executive orders, intentionally implemented an immigration policy at the southern border of the United States that has severely weakened U.S. national security by allowing a flood of citizens of other countries to easily enter this country without proper documentation and without proper screening, all in total disregard for established immigration laws, and that the President has thereby created an opening for individuals from terrorist organizations and criminal gangs to enter into this country with the intent to transport illegal drugs, to commit acts of violence against American citizens, to engage in slave trade, and to otherwise endanger the health, safety and welfare of the citizens of this country.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Board of County Commissioners for Custer County, acting on behalf of the citizens of Custer County, recognize that the actions and conduct of President Joseph R. Biden as set forth above are inconsistent with his oath of office and that his decisions to abandon Afghanistan to the Taliban in a chaotic, frantic, and disorganized manner, and to arm the Taliban to where it now represents a formidable military force and presence in the Mid-East and to open our borders have adversely and significantly endangered the security, economic wellbeing and health of the United States and Custer County Colorado.

BE IT FURTHER RESOLVED that Congress hold President Joseph R. Biden accountable for his actions and charged with the high crime of treason and removed from office.

We, the Board of County Commissioners for Custer County, Colorado, do hereby approve and adopt this Resolution which shall be known as:

A CUSTER COUNTY RESOLUTION CHARGING JOSEPH R. BIDEN FOR THE CRIME OF HIGH TREASON AGAINST THE UNITED STATES AND ITS CITIZENS
