BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF YUBA
RESOLUTION OF THE BOARD OF SUPERVISORS IN SUPPORT OF THE SECOND AMENDMENT AND THE RIGHT OF THE PEOPLE TO KEEP AND BEAR ARMS
RESOLUTION NO. 2021-050
WHEREAS, keeping and bearing arms is a fundamental right of every individual person; and
WHEREAS, the right of individuals to keep and bear arms is necessary for self-defense, keeping of the peace, hunting, and to ensure freedom from government tyranny; and
WHEREAS, the American people have retained to themselves the fundamental individual right to “keep and bear arms” as memorialized in the Second Amendment to the United States Constitution, as part of United States Bill of Rights, ratified on December 15, 1791; and
WHEREAS, the Second Amendment protects the individual right to keep and bear arms from infringement by both the federal and state governments, as recognized by the United States Supreme Court in the cases District of Columbia v. Heller, and McDonald v. City of Chicago; and
WHEREAS, the governments of California and the United States have repeatedly attempted to infringe upon our individual right to keep and bear arms by legislation and regulation; and
WHEREAS, the County of Yuba respects and supports the right of every person to keep and bear arms; and
WHEREAS, this County expects every person to exercise their right to keep and bear arms responsibly and lawfully; and
WHEREAS, this County believes that persons who use arms to commit crime should be prosecuted to the full extent of the law.
NOW, THEREFORE BE IT RESOLVED, that the Board of Supervisors of the County of Yuba respects and supports the right of every law abiding person to keep and bear arms; that the Board expects every person to exercise their right responsibly and lawfully; and that the Board requests that the illegal use of arms to commit crime be investigated and prosecuted to the full extent of the law.
BE IT FURTHER RESOLVED that the Board of Supervisors of the County of Yuba will not abide by any order, provision, law, regulation, or rule that has been determined by a court of competent jurisdiction to violate an individual’s right to bear arms.
PASSED AND ADOPTED at a regular meeting of the Board of Supervisors of the County of Yuba, State of California on the 13 day of April, 2021 by the following vote:
AYES: Supervisors Vasquez, Blaser, Fuhrer, Bradford, Fletcher
