2020-01 Support for the Second Amendment to the US Constitution
A PROCLAMATION OF EVANS COUNTY, GEORGIA DEMONSTRATING EVANS COUNTY’S SUPPORT FOR THE SECOND AMENDMENT TO THE UNITED STATES CONSTITUTION AND TO THE PROVISIONS OF THE CONSTITUTION OF THE STATE OF GEORGIA THAT PROTECT EVANS COUNTY CITIZENS’ INDIVIDUAL, INALIENABLE RIGHTS TO KEEP AND BEAR ARMS.
WHEREAS, Evans County, Georgia is a duly created and validly existing political subdivision of the State of Georgia under the Constitution and laws of the State of Georgia and governed by the Evans County Board of Commissioners, and;
WHEREAS, the Evans County Board of Commissioners is the governing body of the County and is charged with managing the affairs of the County, and;
WHEREAS, the Second Amendment to the Constitution of the United States reads as follows: “A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed,” and;
WHEREAS, Article I, Section I Paragraph VIII of the Constitution of the State of Georgia, entitled “Arms, right to keep and bear,” provides that “[t]he right of the people to keep and bear arms shall not be infringed, but the General Assembly shall have power to prescribe the manner in which arms may be borne,” and;
WHEREAS, O.C.G.A § 1-2-6(a)(9) lists the right to keep and bear arms among the rights of the citizens of the State of Georgia that are without limitation, and;
WHEREAS, many citizens of Evans County, Georgia regard the right of the people to keep and bear arms for defense of life, liberty and property as an inalienable right of the people, and;
WHEREAS, the citizens of Evans County, Georgia derive economic and social benefit from all safe forms of firearms recreation, hunting and shooting conducted within Evans County, and;
WHEREAS, it is the desire of the Evans County Board of Commissioners to declare its support of the Second Amendment to the United States Constitution and to the provisions of the Constitution of the State of Georgia that protect Evans County Citizens’ individual, inalienable rights to keep and bear arms.
RESOLVED, that the Commission hereby declares that the foregoing preamble and whereas provisions set forth herinabove constitute and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this provision.
BE IT FURTHER RESOLVED by the Evans County Board of Commissioners, duly assembled this 8 day of July, 2020 that Evans County, Georgia hereby declares its support for the Second Amendment to the Constitution of the United States and the provisions of the Constitution of the State of Georgia that protect Evans County Citizens’ individual, inalienable rights to keep and bear arms.
BE IT FINALLY RESOLVED that this Proclamation shall be in full force and effect on the date of its adoption by the Evans County Board of Commissioners and that any and all proclamations or parts of proclamations in conflict with this Proclamation shall be, and they are, to the extent of such conflict, hereby repealed.
