Anderson County, Tennessee passed its Second Amendment Sanctuary resolution by a slim margin of one vote. It also passed a resolution in support of the rights and freedoms contained in the Constitution and its amendments.

RESOLUTION  NO. 20-02-801

A RESOLUTION DECLARING SUPPORT OF THE SECOND AMENDMENT TO THE CONSTITUTION OF THE UNITED STATES OF AMERICA

WHEREAS, the Second Amendment to the United States Constitution, adopted in 1791 as part of the Bill of Rights, protects the inalienable and individual rights of the people to keep and bear arms; and

WHEREAS, Article I, Section 26 of the Tennessee Constitution states, “That the citizens of this state have a right to keep and to bear arms for their common defenses; but the Legislature shall have power, by law, to regulate the wearing of arms with a view to prevent crime; and

WHEREAS, the United States Supreme Court in District of Columbia v. Heller, 554 U.S. 570 (2008), affirmed an individual’s right to possess firearms, unconnected with service in a militia, for traditionally lawful purposes, such as self-defense within the home; and

WHEREAS, the United States Supreme Court in McDonald v. Chicago, 561 U.S. 742 (2010), affirmed that the right of an individual “to keep and bear arms,” as protected under the Second Amendment, is incorporated by the Due Process Clause of the Fourteenth Amendment against the states; and

WHEREAS, the United States Supreme Court in United States v. Miller, 307 U.S. 174 (1939) opined that firearms that are part of ordinary military equipment, or with use that could contribute to the common defense are protected by the Second Amendment; and

WHEREAS, it is the desire of the Anderson County Board of Commissioners to declare its support of the Second Amendment to the United States Constitution and to protect the inalienable and individual right to keep and bear arms; and

WHEREAS, the members of the Anderson County Commission each took an oath to support and defend the United States Constitution and the laws which are not deemed unconstitutional by a court of competent jurisdiction.

NOW, THEREFORE, BE IT RESOLVED that the Anderson County Board of Commissioners hereby has declared Anderson County, Tennessee, to be a Constitutional “Second Amendment Sanctuary County,”

BE IT FURTHER RESOLVED that this resolution take effect from and after passage, the public welfare requiring it.

RESOLUTION DECLARING SUPPORT OF OUR MANY FREEDOMS AND RIGHTS CONTAINED IN THE UNITED STATES CONSTITUTION AND ALL SUBSEQUENT AMENDMENTS.

RESOLUTION DECLARING SUPPORT OF OUR MANY FREEDOMS AND RIGHTS CONTAINED IN THE UNITED STATES CONSTITUTION AND ALL SUBSEQUENT AMENDMENTS.

WHEREAS, the United States Constitution has Twenty-Seven Amendments ranging from 1791 until 1992; and

WHEREAS, these Amendments are instrumental to the health and welfare of those who are bound by them to include: Freedom of Assembly, Freedom of Religion, Freedom of Speech, Abolition of Slavery, the Right to Vote, the Right to Bear Arms, the Right to Tax, the Right to he Free from Unreasonable Search and Seizure, Due Process for all, and the many other rights integral to the well-being of the United States and  its Citizenry; and

WHEREAS, it is the desire of the Anderson County Board of Commissioners to declare its support for the United States Constitution and Amendments, to honor those who took an oath to protect the same, to honor those who fought to establish and protect these Rights, to inform our citizenry of these critical Rights found in these beloved documents, and to help them to protect the same.

NOW THEREFORE, BE IT RESOLVED by the Anderson County Board of Commissioners meeting in regular session this 18th day of February, 2020 that we hereby declare Anderson County to be a “Sanctuary County for the United States Constitution and its Amendments,” meaning Anderson County will provide a safe haven, and protect its citizens from any infringement of our beloved United States Constitution and all ratified Amendments.

BE IT FURTHER RESOLVED that this Resolution shall take effect from and after passage, the public welfare requiring same.
