A RESOLUTION FROM THE PIKE COUNTY COMMISSION

Supporting the Second Amendment of the United States Constitution

February 27, 2020

BE IT RESOLVED, that the Commission of Pike County Missouri opposes any current law, Bill, or proposed Bill that desires to restrict the Individuals right of a United States Citizen as protected by the Second Amendment of the United States Constitution.

WHEREAS, the Right of the People to keep and bear arms is guaranteed in the United States Constitution, and reaffirmed in the Missouri Constitution,

AND whereas the Constitution was written to restrict Governments, not the individual,

AND whereas the Right of the People to keep and bear arms for defense of life, liberty and property is regarded as an inalienable Right by the People of Pike County Missouri,

AND whereas the County Commission, the Missouri House of Representatives, the Missouri Senate, and the Missouri Governor were all duly elected and sworn an oath to uphold the Constitution of the United States and the Constitution of the State of Missouri,

AND whereas any proposed legislative Bills under consideration by the legislature of Missouri that would infringe on the Right of the People to keep and bear arms and would ban the possession and use of firearms, magazines, body armor that are now being employed by individual citizens of Pike County Missouri for defense of life, liberty and property and would ban the possession and use of firearms now employed for safe forms of recreation, hunting and shooting conducted within Pike County Missouri, or if the law or Bill would violate the 5th Amendment by failing to provide just compensation under the Takings Clause, violate the 8th Amendment by impositions against excessive fines and punishments on law abiding citizens by punitive relinquishment of lawfully owned property, and any Ex Post Facto law clause of the United States Constitution;

NOW THEREFORE IT BE AND HEREBY RESOLVED, that the people of Pike County Missouri do hereby oppose enactment of any legislation that would infringe upon the Right of the People to keep and bear arms and consider such laws to be unconstitutional and beyond lawful legislative authority.

BE IT FURTHER RESOLVED, that the County Commission of Pike County Missouri demands the Missouri General Assembly cease any further action restricting the Right of the People to keep and bear arms and hereby demand the Governor of Missouri veto all such legislation which restricts the Right of the People to keep and arms.

ITS FURTHER RESOLVED, that the Clerk of Pike County is hereby directed to prepare and deliver certified copies of this Resolution to all members of the Missouri General Assembly and to the Office of Governor.

BE IT FURTHER RESOLVED, that if the State Government of Missouri shall infringe upon the inalienable Right to keep and bear arms granted in the Second Amendment of the United States Constitution, Pike County Missouri shall become a sanctuary county for all fire arms unconstitutionally prohibited by the State of Missouri in that Pike County will prohibit its employees from enforcing the unconstitutional laws of the State Government.
